These Terms of Service ("Terms") govern your use of the SpotHK mobile application and website at spothk.navbytes.io (collectively, the "Service") operated by navbytes ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using SpotHK, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

SpotHK is a community-driven parking finder application that provides information about parking spots in Hong Kong, including locations, pricing, facilities, and real-time vacancy data where available. The Service is provided for informational purposes and to assist drivers in locating parking.

3. User Accounts

  • You may browse parking data without an account. To contribute (add spots, edit details, upload photos), you must create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information when creating an account.
  • You must be at least 13 years old to create an account.

4. User Contributions

When you contribute content (parking spot data, edits, photos, reviews), you:

  • Grant us a worldwide, royalty-free, non-exclusive licence to use, display, and distribute the content within the Service.
  • Represent that the content is accurate to the best of your knowledge.
  • Represent that you own or have the right to share the content.
  • Agree not to submit content that is misleading, defamatory, obscene, or infringes on third-party rights.

We reserve the right to remove or modify any user contribution that violates these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Submit false, misleading, or spam parking data.
  • Attempt to access other users' accounts or data.
  • Scrape, harvest, or extract data from the Service in an automated manner without written permission.
  • Interfere with the operation of the Service or its infrastructure.
  • Circumvent rate limits or security measures.

6. Intellectual Property

The SpotHK name, logo, design, and source code are the property of navbytes. Parking data sourced from data.gov.hk is used under the Hong Kong Government's terms for public data. User contributions remain the property of their authors subject to the licence granted in Section 4.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • Parking data is complete, accurate, or up-to-date.
  • Real-time vacancy information reflects actual availability at any given moment.
  • The Service will be uninterrupted, timely, or error-free.
  • Pricing information shown is current — always verify with the car park operator.

SpotHK is an informational tool. Always verify parking availability, pricing, and restrictions on-site before parking your vehicle.

8. Limitation of Liability

To the fullest extent permitted by law, navbytes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to parking fines, towing fees, vehicle damage, or reliance on inaccurate data.

9. Third-Party Services

SpotHK integrates with third-party services including Apple Maps, Google Maps, Waze, aMap, Supabase, and Cloudflare. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the conduct or availability of third-party services.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting spothk@navbytes.io.

11. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
